Can Medicaid take money from a lawsuit for a deceased relative?

Query by Brian A: Can Medicaid get money from a lawsuit for a deceased relative?
My grandfather as a youthful man spent considerably of his existence working in vehicle outlets. unfortunately he was introduced to excellent quantities of asbestos. This led to his eventual passing. he invested the ultimate a long time of his existence in a nursing residence which was covered by Medicaid. Now there is a lawsuit relating back to the asbestos and Medicaid feels that they are entitled to the majority of that funds. How could they quite possibly do that? is there anyway to quit them? please help, we tended to his assist for years without having Medicaid’s help. I sense as though my family really should be the recipients of any settlement.

If there was no estate recovery approach for Medicaid, Medicaid programs would go bankrupt. Nursing residence care expenses, at a minimum, at least $ 7,000 per month. If your grandfather was in a nursing house for two many years, that is $ 168,000+ that the good taxpayers of your state compensated for his care. Do you not think that they should get at least a portion of that again? When you consider how a lot of people in nursing properties are on Medicaid this rapidly turns into a Very pricey consideration.

You could sense entitled to your grandfather’s funds, but however what you really feel entitled to is not what the law entitles you to. The state paid a lot of cash for your grandfather’s care, the state is going to attempt and recover some of that price. This was explained to your grandfather and other loved ones members when he utilized for his Medicaid grant.

ADD: Please don’t assume I’m trying to be insensitive or minimize the expenses your loved ones bore. It really is just that, rightly or wrongly, we’ve determined to run healthcare as a enterprise in this country. I see family members all the time who are unpleasantly astonished to discover about the Medicaid estate recovery procedure when they go to offer a loved one’s house right after they die.

Awards and settlements due to bodily injury and bodily illness are tax free.

Any part of the award that is for interest, lost wages, or punitive damages is entirely taxable IF those amounts are stated individually.

I think you might also be able to sue if you experience from an interstitial lung disorder called asbestosis. It is a situation in which your lungs cannot breathe appropriately simply because the asbestos has restricted the capacity of the lungs to inflate and deflate.
